 Burn only on a stable heat resistant surface. Keep from drafts. Do not burn candle when wax is less than 1/2 inch from bottom. Do not touch or move candle while burning or if wax is hot. Never leave candle burning unattended. Keep out of reach of children.

Terms of Sale

These Terms of Sale (“Terms”) govern the sale of Products by Designs by Brachel, LLC (“Dulce Candles”) to you. 

PLEASE READ THESE TERMS CAREFULLY BEFORE YOU SUBMIT ANY ORDER TO DESIGNS BY BRACHEL, LLC 

By placing an order to DESIGNS BY BRACHEL, LLC through dulcecandles.com, you agree to be bound by these Terms.

OUR CONTRACT

Your order constitutes an offer to Dulce Candles to purchase the product(s) in your order. When you place an order for a product on Dulce Candles, we will send you an email confirming receipt of your order and containing details of your order ("Order Confirmation Mail"). An Order Confirmation Email is an acknowledgment that we have received your order and does not confirm acceptance of your offer to purchase the product(s) ordered. We do not accept your offer and enter into a contract of sale of the Product requested by you only when we have shipped the Product(s) to you and send you an email notification confirming that we have shipped the Product(s) to you ("Shipping Confirmation Letter"). If your order is shipped in more than one package, you may receive a separate Shipping Confirmation for each package and each Shipping Confirmation Letter and its shipment will be deemed a separate contract of sale between us in relation to the product(s) identified in that Shipping Confirmation Letter. Your contract is with Designs by Brachel, LLC. You can and Dulce Candles can cancel an order for a product at no cost at any time before we send a Shipping Confirmation Letter for that product. 

You agree to receive sales invoices electronically. Submit electronic sales invoices in PDF format, in your account on dulcecandles.com. For each delivery, we will notify you via a Shipping Confirmation message of the availability of the e-invoice. Dulce Candles focuses on business development for end users and prohibits resales by retail sellers. Resale by retailers refers to the behavior of a customer who resells products purchased from Dulce Candles to his direct customers. If Dulce Candles discovers that you are reselling merchandise purchased from Dulce Candles, we reserve the right not to allow your account to purchase merchandise and we may also close your account permanently.

RISK OF LOSS

All purchases of physical items from Dulce Candles are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

RETURNS, REFUNDS AND TITLE

Title of returned items transfers to Dulce Candles only when the item arrives at our fulfillment centers. At our discretion, we may issue a refund without the need to return the item. In such a case, the title of the returned item does not transfer to Dulce Candles. 

WARRANTY

Dulce Candles provides a warranty of up to 3 months on certain merchandise purchased in the United States. This warranty obligation is limited to the repair of a defective product, exchange of a defective part, exchange of the product itself, or refund of the value of the product at its price at the time of repair or exchange, as determined by Dulce Candles. 

PRODUCT DESCRIPTIONS

Dulce Candles attempts to be as accurate as possible. However, Dulce Candles does not warrant that product descriptions or other content of any Dulce Candles Service is accurate, complete, reliable, current, or error-free. If a product offered is not as described, your sole remedy is to return it in unused condition. 

PRICING AND AVAILABILITY

All prices are non-inclusive of the applicable taxes including sale tax.

We provide information about the availability of products sold by us on dulcecandles.com, including information on each product information page. Other than the information on that page or on dulcecandles.com, we cannot provide additional specific information about the availability of products. As we process your order, we will let you know by email as soon as possible if any of the products you ordered are out of stock and will refund you if you have paid for them.

Please note that unless otherwise stated on dulcecandles.com, estimates regarding delivery times are estimates only, and these estimates are not guaranteed and should not be relied upon.

Despite our best efforts, there may be a few items in our catalog that are incorrectly priced. We will confirm prices when we process your order. If we have made a mistake and the correct price of a product is higher than the price on dulcecandles.com, we may either contact you prior to shipment to confirm whether you wish to purchase the product at the correct price or cancel your order. If the correct price of the product is less than the advertised price, we will charge you the lower price and send the product to you.

OUR RESPONSIBILITY

Dulce Candles and its affiliates shall not be liable for (i) losses not caused by any breach by us, or (ii) any business losses (including lost profits, revenue, contracts, anticipated savings, data, reputation, or expenses), or (iii) any direct, indirect, incidental, punitive or consequential losses. 

We will not be liable for any delay or failure to meet our obligations under these Terms if the delay or failure is caused by any cause beyond our reasonable control. In the event of a delay occurring before the products are shipped, you may cancel the order at any time prior to shipment.

DISPUTES

Any dispute or claim relating in any way to your order or purchase of any Dulce Candles products from dulcecandles.com will be adjudicated in the state or Federal courts in Maricopa County, Arizona, and you consent to exclusive jurisdiction and venue in these courts. We each waive any right to a jury trial.  

APPLICABLE LAW

By purchasing any Dulce Candles products, you agree that applicable federal law, and the laws of the State of Arizona, without regard to principles of conflict of laws, will govern these Terms of Sale and any dispute of any sort that might arise between you and Dulce Candles.

AMENDMENTS TO THE TERMS OF SALE

We reserve the right to make changes to our dulcecandles.com and Dulce Candles policies and these Terms of Sale at any time. You will be subject to the policies and Terms of Sale in effect at the time the Products are ordered from us. 

SEVERABILITY 

If any provision of these Terms of Sale is declared void or unenforceable, such provision shall be deemed severed from this Terms of Sale, which shall otherwise remain in full force and effect. 

CHILDREN

We do not sell products to be purchased by children. If you are under the age of 18, you may use the Dulce Candles Services with the participation of a parent or guardian.

WAIVER 

Failure of Dulce Candles to exercise any right or option arising out of a breach of this Terms of Sale shall not be deemed a waiver of any right or option with respect to any subsequent or different breach, or the continuance of any existing breach.
